There is a mandatory provision that the election of a candidate as Deputy Speaker of Lok Sabha shall be from either the principal opposition party or the ruling party. 3. Which of the statements given above are correct?

  1. 1 and 3 only
  2. 1, 2 and 3
  3. 3 and 4 only
  4. 2 and 4 only

Answer

1 and 3 only

1. Correct. Under Rule 8 of the Rules of Procedure and Conduct of Business in Lok Sabha, the election of the Deputy Speaker is held on such date as the Speaker may fix.

2. Incorrect. There is no mandatory constitutional or rule-based provision that the Deputy Speaker must be from the opposition or ruling party; it is only a matter of convention/political practice.

3. Correct. When presiding, the Deputy Speaker has the same powers as the Speaker, and his rulings in the House are not subject to appeal in the House.

4. Incorrect. The motion for election of Deputy Speaker is not a well-established practice of being moved by the Speaker and seconded by the Prime Minister; members move and second the motion, and no such fixed parliamentary practice exists.
